General Terms and Conditions of Sale

ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

1. The contract stipulated between ESSEDI PASTA SRL and the Customer (i.e. the subject, physical person, who makes the purchase on the Site, not referable to his own commercial, entrepreneurial or professional activity) must be considered concluded with the acceptance, even only partial, of the order by ESSEDI PASTA SRL. In the case of non-acceptance of the order, ESSEDI PASTA SRL will provide to give in any case timely communication to the Customer.
2. By placing an order in the various ways provided, according to the order form on the Site (hereinafter the Order), the Customer declares that he/she has read all the information provided to him/her during the purchase procedure and fully accepts these general conditions (hereinafter the Conditions).
3. These Conditions may be printed or saved on a durable medium, in compliance with the provisions of Article 12 of Legislative Decree 70/2003 and Article 51 of Legislative Decree 206/2005, as amended by Legislative Decree. 21/2014.

MODE OF PURCHASE

1. The products offered for sale by ESSEDI PASTA SRL are only those present on the site of ESSEDI PASTA SRL at the moment of the forwarding of the Order, as described in the relative informative sheets.
2. It is in any case understood that the images accompanying the descriptive sheet of a product are for information purposes only and may not be perfectly representative of its characteristics but differ e.g. in color and size (also due to the browser and monitor used to access the Site and view the images).
3. The Customer to make an Order will have to compile in every part the relative form present on the Site and to send the same one after having carefully viewed the Conditions, as well as the characteristics of the product and/or of the products that he intends to purchase. The Customer will also have to ask ESSEDI PASTA SRL, if it wishes, the issuance of tax invoice related to the purchase, pursuant to art. 22 D.p.R. n. 633/1972.
4. The correct receipt of the Order is confirmed by ESSEDI PASTA SRL by means of a reply by e-mail, sent to the e-mail address communicated by the Customer. This confirmation message will briefly report the conditions of purchase, as provided by the applicable legislation, as well as the data entered in the Order by the Customer, so that the same can verify them and possibly communicate without delay the necessary corrections of incorrect data.

PRICES AND PAYMENT METHODS

1. The prices shown on the site are inclusive of taxes and VAT. Any shipping costs or payment charges are in any case communicated in advance to the Customer through the site or these Conditions.
2. The following payment methods are provided:
   • Stripe: The Stripe circuit may be used by the customer for payment according to its specific terms. The customer may pay by credit or prepaid card by going through the Stripe circuit or PayPal if they have an account.

DELIVERY OF PRODUCTS AND RELATED EXPENSES

1. The purchased products will be delivered by courier to the address indicated by the Customer in the Order within 2-4 working days from the acceptance of the Order by ESSEDI PASTA SRL. Shipping times for some more remote areas of Italy may be delayed by 1-2 days. ESSEDI PASTA SRL reserves the faculty to accept or not deliveries required outside Italian or European borders. In any case, for deliveries to be made outside Italian borders, shipping costs and delivery times could undergo variations.
2. With regard to deliveries requested to countries outside the European Union, any customs import charges will be borne by the recipient. Therefore, the Customer is invited to contact the customs authorities of his/her country in advance to verify the costs and possible import limits.
3. The times of delivery indicated by ESSEDI PASTA SRL must be considered as purely indicative and a delay with respect to the same, that is, any delivery made with successive fractionated shipments do not legitimize the Customer to the refusal of the same delivery and to the request for compensation or indemnity.
4. Upon delivery of the products, the Customer is required to check:
   • That the number of packages being delivered corresponds to what is indicated in the transport document;
   • That the packaging is undamaged, undamaged, not wet or otherwise altered, including in the sealing materials (adhesive tape or metal strapping).
   Any damage to the packaging and / or the product or the mismatch in the number of packages or indications, must be immediately detected, making a specific indication on the delivery document of the product to be returned to the courier. Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, in the manner provided herein.
5. Shipping costs are specified on the Site before the Order is placed. Costs vary depending on the quantity of products selected in the Order. In detail, the following shipping charges apply:

RIGHT OF WITHDRAWAL AND REFUND

1. Pursuant to Article 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer may withdraw from the Conditions and therefore from the purchase contract for any reason, without the need to give reasons and without penalty, within 14 (fourteen) working days from the date of receipt of the products.
2. In order to exercise the right of withdrawal referred to in Article 5.1 above, Customer must send ESSEDI PASTA SRL a communication to that effect, within the terms indicated, to the following email address [email protected], indicating in each case the order number, the Product(s) for which it intends to exercise the right of withdrawal and its address.
3. In case of withdrawal, the Customer must re-send at his own expense the products to ESSEDI PASTA SRL within 14 (fourteen) days from the withdrawal itself to the following address: Essedi Pasta SRL – Via Guido Rossa 78/4 – 59015 Carmignano (PO). The goods must be returned undamaged, complete with all its parts and in the original packaging (envelopes and packages), kept and possibly used for the time strictly necessary to establish and verify the nature, characteristics, according to normal diligence, without any signs of wear or dirt, in compliance with the following conditions: the right of withdrawal may apply to the product purchased in its entirety; in fact, it is not possible to exercise withdrawal only on part of the product purchased (eg.: only for some packages); for the withdrawal to be possible, the product must be intact and returned in its original packaging, complete in all its parts; the shipping costs(and any customs charges, if any) for the return of the good will be at the sole expense of the customer. ESSEDI PASTA SRL reserves the right to request photographic evidence before authorizing returns for defective goods.
   The shipment, until the certificate of receipt at the place indicated by ESSEDI PASTA SRL, is under the complete responsibility of the customer; in case of damage of the good during transport, ESSEDI PASTA SRL will give notice to the customer, to enable him to file a timely complaint against the courier chosen by him and obtain the relative reimbursement; the product will then be put at the disposal of the customer, at the same time canceling the request for withdrawal; ESSEDI PASTA SRL will not respond in any way for damage, theft, loss occurred during or however in dependence of the shipment for the return.
4. Reimbursement
   ESSEDI PASTA SRL will refund the Customer the entire amount already paid, net of any additional shipping costs (pursuant to art. 56, paragraph 2, of Legislative Decree 21/14) once the warehouse has received and checked the return (up to 10 working days are necessary), by means of a transfer procedure of the amount charged, using the same means of payment used by the Customer for the initial transaction, unless otherwise agreed. In any case, the Customer will not incur any cost as a consequence of said refund. ESSEDI PASTA SRL will be able to suspend the reimbursement until the receipt of the returned product or until the moment in which the Customer demonstrates to have correctly sent back the product, if previous.
5. In any case, the Customer will forfeit the right of withdrawal in cases where ESSEDI PASTA SRL ascertains that:
   • the returned product and/or its accessories, and/or its packaging are not intact;
   • the product is missing its original outer packaging and/or inner packaging;
   • the product is missing items integral to it and/or accessories.
   In case of forfeiture of the right of withdrawal, ESSEDI PASTA SRL will return to sender the product purchased, charging the same shipping costs and, where already refunded, the price of the product.
